TERMS AND CONDITIONS Liability: Customer acknowledges that the Websitetoday is not liable for any act or omission of any other company or companies furnishing a portion of any service to the Customer and shall be indemnified and held harmless by the customer against all claims for liable, slander, infringement of copyright or unauthorized use of trademark, trade name, or service mark arising out of the material, data, information, or other content provided by Customer for the development and or installation of the Customers Web Site. Websitetoday is not liable for any acts or claims made by independent authorized Consultants. Websitetoday makes no expressed or implied warranty of any kind in regard to these services. Service is rendered on an "as is" basis, without any other warranties, or conditions, express or implied, including but not limited to warranties for merchantable quality, merchantability, or fitness for a particular purpose, or those arising by law, statute, usage of trade, or course of dealing. The Internet is a very large, unreliable network. Some parts of the Internet will be not working at any given time, and this is outside Websitetoday's control. Customer accepts that faults will occur from time to time and that Websitetoday is not liable for any faults experienced in the Websitetoday software, network or the public Internet. If a fault occurs within the Websitetoday software or network, it will be fixed as soon as possible. By using the Websitetoday services, the Customer accepts to be bound by these Terms and Conditions.</p> Billing: Customer agrees to pay for, and Websitetoday agrees to provide services for which invoices are issued. Network traffic in excess of the monthly allowance for the chosen plan will be charged at the rate of 22 cents per Megabyte. The Business package has an allowance of 100Mb of traffic per month. The Family package has an allowance of 50Mb of traffic per month. Cancellation: Websitetoday may discontinue hosting or cancel production for a service without incurring any liability for any of the following reasons: 1) Non-payment of any sum due to Websitetoday for service. 2) A violation of any law, rule or regulation of any governing authority having jurisdiction over the service. 3) By order of a court or other governmental or quasi-governmental authority having such jurisdiction. 4) The Customer provides false or misleading credit information.
